Requirements
In proceedings under the Probate Code, the forms approved by the New Mexico Supreme Court may be used where applicable. Any document submitted to the court should substantially include the content of the approved form. You may download the forms from the Supreme Court's website or purchase a packet in our office. When printing probate documents from the Supreme Court website, please print only single-sided.
To file a probate, you must provide:
*An application for an Uncontested Informal Probate
*An original death certificate
*Original Last Will and Testament (if decedent had one)
The decedent's death must not have occurred less than 120 hours ago and no more than 3 years from the time of filing.
Fees
Probate Packets (with or without a will) - $5.00
Initial Filing Fee of Probate - $30.00
Copies - $.15 per page
Certifications - $.50 per document
Clerk's Certificate - $1.50
Exemplification Certificates - $1.50
