Notice of Right to Inspect Public Records

In accordance with the Inspection of Public Records Act, (IPRA), Section 14-2-1 NMSA 1978, as amended, every person has the right to inspect public records maintained by Chaves County with certain exceptions. A “public record” is defined to include any document, tape, or other material, regardless of form that is used, created, received, maintained or held by or on behalf of a public body, and is related to public business.

Procedures for Requesting Inspection

Chaves County accepts IPRA requests in-person or by mail, fax, or email. Requests should be directed to the contact information listed below.

Records requests may be submitted orally or in writing. However, the procedures and penalties prescribed by the Inspection of Public Records Act apply only to written requests. Written requests must have the name, address, and telephone number of the person making the request. The request must describe the records sought in sufficient detail to enable identification and location of the requested records.

Records will be available as soon as practicable, but no later than 15 calendar days after the request is received. If a request is deemed as burdensome and requires additional time, a written explanation will be sent to the requestor within 15 calendar days. If any of the records are unavailable for inspection, a written response will be sent within 15 calendar days explaining the reasons inspection has been denied.

Procedures for Requesting Physical Copies and Fees

Reasonable fees will be charged for copies of public records. The fee for printed or scanned documents is $.25 per page. The fee for CD or DVD is $10.00 per disc. To receive records electronically, USB drives are $20.00 each or an electronic link through OneDrive is $20.00. There will be an additional fee for USPS postage if records are to be shipped. Fees must be paid before records will be released. A receipt indicating that fees have been paid will be provided upon request.
